Commercial Terms and Conditions



Selling terms make an integral part of any Purchase Contract and the Purchaser is obliged to accept them by ordering goods.

  1. The Seller is the company Ivan Chalupa with its registered office in Pod bastami 7/299, 16000 PRAGUE 6, ICO: 71659935, operator of the Internet store www.carnivalvenicemask.com.
  2. The Purchaser orders goods offered on Seller's Internet site . www.carnivalvenicemask.com
  3. All data in the order form shall be correctly filled in. If the order form is filled in incompletely, it cannot be considered as a proper order. If the order cannot be accepted (for example because of an incorrectly or incompletely filled-in order form), the Seller will contact forthwith the Consumer by e-mail and try to obviate the impediments as soon as possible.
  4. By means of the order form, the Purchaser can also order goods to be delivered to the place of delivery other than his/her registered residence. In such a case the Purchaser will enter the name and address of goods delivery in the order form. At this address, the addressee can be also called on to pay the amount for the ordered goods according to the type of the method of payment selected by the Ordering party.
  5. Upon the acceptance of the order, the Seller and the Consumer shall agree on a specific date of delivery of ordered goods in the term as soon as possible (phone, e-mail).
  6. The goods are delivered by EMS, ( Expres Mail Service ).Transport an packing fee depend on destination and weight.
  7. A tax document with all requisites will be always supplied together with the ordered goods. The Purchaser or another person collecting the goods authorized hereto by the Purchaser, shall confirm with its signature the due collection of the ordered goods.
  8. By handing over the ordered goods to the Purchaser (or to a person authorized hereto) and by collecting these goods by the Purchaser (or to a person authorized hereto), the Purchaser and Seller enter into the Purchase Contract on the sale of goods ordered by the Consumer for the purchase price stipulated in the handed over tax document.
  9. If the goods are not handed over and collected during the first delivery, the carrier authorized by the Seller will negotiate a repeated delivery date with the Purchaser. In this case the Purchaser (provided the reason for the impossibility of the delivery was on his part) is obliged to pay to the Seller together with the price of the goods also the charged transport charges connected with a repeated delivery of ordered goods.
  10. While collecting the ordered goods, the Purchaser shall check in his own interest whether the goods are not damaged and the handed over documents are complete. The carrier shall be notified of the eventual damage of goods and he shall write a survey report about this damage. (If such a report is not written during the handing over and collecting goods, it is considered as a fact that the goods were delivered undamaged). If the transported goods are damaged upon the delivery, the carrier shall take it back immediately and negotiate forthwith the delivery date of new goods with the Customer by phone.
  11. For the ordered goods supplied by the Seller, the Purchaser shall pay to the Seller the price of these goods contained in the current Internet catalogue of the Seller valid at the date of Purchaser's ordering.
    • Measurments and color of each product may vary slighty from models shown.
    • Masks will be delivered after of full purchase price.
    • Customers are not responsible for customs and tax fees.
    • Insurance is included in the transport and packing fee.
    • No minimum quantity of ordered goods is stipulated.
    • Your adress and personal data will never be disclosed to any person.
  12. The Consumer has a right to withdraw from the Purchase Contract on the ordered goods sale within 14 days from the collecting of these goods (Section 53 Art. 6, sentence one, Civil Code). The prerequisite of returning the purchase price for the ordered goods paid by the Consumer is in such a case the return of the goods supplied by the Seller including all its accessories in complete, unused, undamaged, unsoiled and hygienically unobjectionable state. If the Purchaser withdraws from the Purchase Contract in a due manner, the Seller shall return to the Consumer the purchase price in its full amount from which the sum for the incurred transport costs will be deducted.
  13. The Purchaser will pay the purchase price of the ordered goods in the following way:

    Guarantee Conditions

  14. The guarantee for the goods sold to the Purchaser by the Internet sale operated by the company Ivan Chalupa, contact person Mr. Ivan Chalupa(hereinafter referred to as "the Seller"), is governed by applicable provisions in force of the Civil Code and of the Consumer Protection Act.
  15. The Seller will provide a statutory guarantee to the Consumer.
  16. The guarantee period lasts 24 months since the collection of the purchased goods by the Consumer.
  17. All rights resulting from the guarantee shall be claimed by the Consumer at the Seller forthwith after the occurrence of a defect, but at the latest before the elapse of the guarantee period. The contact person is Mr. Ivan Chalupa, e-mail chalupa@carnivalvenicemask.com.
  18. The Seller will carry out the guarantee repair or the exchange of goods according to the circumstances as soon as possible, but at the latest 30 days from the day of the finding of the claimed removable defect. The Consumer shall provide the Seller the cooperation necessary for the finding of the claimed defect (including carrying out a functional test if necessary), for the eventual transport of the defective goods to the repair shop and back and for the removal of goods defect.

The guarantee does not apply to:
- Defects caused by outside impacts, such as the damage of goods during their transport, removal to other place, other handling or incorrect use,
- Defects caused by the use of goods at variance with the User's Manual or with the usual way of use or by the use of excessive force,
